In 2025, the BC courts declared that the Cowichan Tribes have Aboriginal title to 750 acres of land in Richmond, BC (much of which is fee simple and road). Let\’s examine six things: The test for Aboriginal title, how boundaries give meaning to Aboriginal title, the facts of the decision, the gaslighting/fearmongering since the decision, the appeals by Richmond and British Columbia, and the ethical/existential duty of surveyors.
Bio:
Dr Brian Ballantyne is an honorary surveyor (ALS and OLS), lawyer, and analyst. He assists surveyors, lawyers, landowners, courts, the Crown, and First Nations with boundary, tenure, and survey issues. He renders opinions, produces reports, presents seminars, and supervises students. He has worked at the University of Otago, the University of Calgary, the City of Calgary, Challenger Geomatics, and Natural Resources Canada.
